An Update on the May 2026 Ruling on Mifepristone Access

On May 1, 2026, the U.S. Court of Appeals for the 5th Circuit issued a temporary nationwide stay on the FDA rule that had allowed mifepristone to be prescribed by telehealth and dispensed by mail. The ruling stems from Louisiana v. FDA. The federal authorization that permitted mailing mifepristone after a telehealth consultation is paused while the litigation continues.
